Article 2 - Presentation of the site
The purpose of the website https://handee.fr/ is:
- to offer advisory services in the creation and management of real estate and financial wealth,
- intermediation services in brokerage, insurance, management and property purchase transactions.
The main services offered to USERS are:
- A personalised study enabling the collection of information on the situation of the USER and/or their co-purchaser in order to determine their financing capacity as well as their eligibility for a real estate investment solution
- New-build property developments offered by our developer partners
- Information relating to credit agreements and insurance contracts
- The collection of data necessary for the analysis of financing or insurance applications
- Financing and brokerage simulators, in particular for mortgage loans, featuring ranges of nominal and insurance rates through its partners meilleurtaux.com, Cafpi, Artemis Courtage and Hellopret.
- Rental management services through our partner Homepilot.
Searches for financing and insurance from credit institutions or insurance companies require the USER to give a capital search mandate to the BROKER (the PUBLISHER), a contract separate from these GENERAL TERMS of USE (or GTU).
Searches for financing and insurance enable:
- The selection of mortgage loan and borrower insurance offers from companies and institutions in the French market.
- The presentation, proposal or assistance with the conclusion of loan or insurance contracts.
- Putting USERS in contact with approved credit institutions or insurance organisations.
Non-occupant owner insurance, unpaid rent guarantees, legal protection and rent collection require the USER to obtain a quote from the PLATFORM, which integrates Insured's platform under a white label.
Where there are two co-borrower applicants, the USER who registers for the PLATFORM's services is responsible for obtaining a mandate from the other co-borrower applicant to provide, accurately and faithfully, the latter's information and personal data, which the latter checks and validates. The PUBLISHER draws the USER's attention to the fact that seeking financing on behalf of a couple requires the individual consents of each borrower and each subscriber, as does the conclusion of a credit or insurance contract. Any breach of this article may result in the temporary or permanent suspension of the relevant USER's access to the PLATFORM.
USERS benefit from the services offered by the PUBLISHER Handee, described herein. These GENERAL TERMS of USE (GTU) are intended to govern the use of the PLATFORM by the USER to whom the PUBLISHER has freely provided personal login credentials. The PUBLISHER reserves the right to modify these GTU at any time. The new provisions will be brought to the attention of USERS at least fifteen (15) days before their date of entry into force and application.

Article 4 - Acceptance of the terms of use
Access to and use of the site are subject to acceptance of and compliance with these General Terms of Use.
The PUBLISHER reserves the right to modify, at any time and without notice, the site and its services as well as these GTU, in particular to adapt to developments of the site by making new features available or by removing or modifying existing features.
Users are therefore advised to refer to the latest version of the GTU before browsing, accessible at any time on the site. In the event of disagreement with the GTU, the user may not make any use of the site.
Article 5 - Access and browsing
Access to the site and its use are reserved for persons of legal age. The PUBLISHER shall be entitled to request proof of the user's age, by any means.
By accepting the GENERAL TERMS of USE (or GTU), the USER gives a mandate to the PUBLISHER, which accepts it, to perform on the USER's behalf the SERVICES that the USER requests from it. The provision of the PLATFORM gives rise to the opening of a personal individual space, accessible by means of login credentials. The USER guarantees and ensures the accuracy of the personal information concerning them; the USER notifies the PUBLISHER of any necessary updates.
The PUBLISHER implements the technical solutions at its disposal to enable access to the site 24 hours a day, 7 days a week. It may nevertheless at any time suspend, limit or interrupt access to the site or to certain pages thereof in order to carry out updates, changes to its content or any other action deemed necessary for the proper functioning of the site.
Connecting to and browsing the website http://handee.fr/ constitute unreserved acceptance of these General Terms of Use, whatever the technical means of access and the devices used. These GTU apply, as necessary, to any variation or extension of the site on existing or future social and/or community networks.
Article 6 - Site management
For the proper management of the site, the PUBLISHER may at any time:
- suspend, interrupt or limit access to all or part of the site, restrict access to the site, or to certain parts of the site, to a specific category of internet users;
- remove any information likely to disrupt its operation or that contravenes national or international laws, or the rules of Netiquette;
- suspend the site in order to carry out updates.
The PUBLISHER may not be held liable:
- in the event of a temporary or permanent interruption of access to and availability of the handee.fr website, in particular for technical maintenance purposes, updating of published information or any development requiring the interruption of the service;
- this, regardless of any damage that may be caused to the USER resulting from the content, the inability to access, or the use of the handee.fr website
Article 7 - Services reserved for registered users

Registration and access to the site's services are reserved exclusively for natural persons of legal age and capacity who have completed and validated the registration form available online on the website http://handee.fr/, as well as these General Terms of Use.

The user must therefore provide a valid email address, to which the site will send confirmation of their registration for its services. An email address may not be used more than once to register for the services.
Any communication made by http://handee.fr/ and its partners is consequently deemed to have been received and read by the user. The user therefore undertakes to regularly check the messages received at this email address and to reply within a reasonable time if necessary. Only one registration for the site's services is permitted per natural person.
The user is assigned a username giving them access to a space reserved for them (hereinafter "Personal Space"), in addition to entering their password.
The username and password can be changed online by the user in their Personal Space. The password is personal and confidential, and the user therefore undertakes not to disclose it to third parties. http://handee.fr/ reserves the right in any event to refuse a registration request for the services if the user fails to comply with the provisions of these General Terms of Use.
2. Unsubscription
A duly registered user may at any time request to unsubscribe by going to the dedicated page in their Personal Space. Any unsubscription from the site will take effect after the user has completed the form provided for this purpose, within the following period: 15 days.
Article 8 - Liability
The PUBLISHER is only responsible for the content it has itself published.
The PUBLISHER is not responsible:
- In the event of technical or IT issues or failures, or compatibility issues of the site with any hardware or software whatsoever;
- Direct or indirect, material or immaterial, foreseeable or unforeseeable damage resulting from the use of, or difficulties in using, the site or its services;
- The intrinsic characteristics of the Internet, in particular those relating to the lack of reliability and the lack of security of the information circulating on it;
- Illicit content or activities using its site without its due knowledge within the meaning of Law No. 2004-575 of 21 June 2004 on confidence in the digital economy and Law No. 2004-801 of 6 August 2004 on the protection of natural persons with regard to the processing of personal data.
Furthermore, the site cannot guarantee the accuracy, completeness and currency of the information published on it.
The user is responsible:
- For the protection of their hardware and data;
- For the use they make of the site or its services;
- If they respect neither the letter nor the spirit of these GTU.
Article 9 - Hyperlinks
The site may contain hyperlinks pointing to other websites over which http://handee.fr/ has no control. Despite prior and regular checks carried out by the PUBLISHER, the latter declines all responsibility for the content that may be found on these sites.
The PUBLISHER authorises the creation of hyperlinks to any page or document of its site provided that such links are not created for commercial or advertising purposes. In addition, the PUBLISHER of the site must be informed in advance before any hyperlink is created.
Excluded from this authorisation are sites disseminating information of an illicit, violent, controversial, pornographic or xenophobic nature, or likely to offend the sensibilities of the general public.
Finally, http://handee.fr/ reserves the right to remove at any time a hyperlink pointing to its site, if the site deems it inconsistent with its editorial policy.

By browsing the site, the user declares that they have also read the aforementioned privacy policy.
The PUBLISHER collects and uses personal data in order to provide the services described. The collection and processing of this data are essential to the delivery of these services. Article 11 - Warning to borrowers and loan applicants
Credit and insurance transactions involve risks.
A loan commits you and must be repaid. Check your repayment capacity before committing yourself.
No payment, of any kind whatsoever, may be required from a private individual before one or more money loans are obtained. HANDEE does not request any remuneration from USERS or from private individuals benefiting from its services. HANDEE is remunerated through commissions paid by property developers and other partner organisations, in return for the distribution costs borne directly by the PUBLISHER and subject to the actual disbursement of the loaned funds. For any mortgage loan, the borrower has a cooling-off period of ten (10) days; the purchase is conditional upon obtaining the loan, and if it is not obtained, the seller must refund the sums paid.
The credit offered, as well as its ancillary services, may have consequences for the borrower, including in the event of payment default. Payment default characterises the borrower's failure as soon as a single instalment is not repaid, whether in full or in part. In the event of default in the payment of instalments, the lender may demand immediate repayment of the entire outstanding capital, increased in particular by accrued and unpaid interest as well as compensation from the borrower, in particular if guarantees are enforced. Where the guarantee consists of a surety granted by a professional guarantee organisation, the lender informs the borrower of the nature, the beneficiaries and the conditions under which it may be called upon, and of the consequences for the borrower.
Borrower insurance is an insurance contract taken out by the borrower, often at the request of the lending credit institution, in order to guarantee, should one of the risks defined by the contract occur, either the full or partial repayment of the outstanding loan amount, or the payment of all or part of the instalments of said loan. Until the borrower signs the loan offer, the lender may not refuse as collateral another borrower insurance contract as long as that contract offers a level of cover equivalent to the group insurance contract it offers.
If the borrower exercises the right of annual termination of the borrower insurance contract, the lender shall notify the borrower of its decision to accept or refuse within ten working days of receipt of another insurance contract.
The insured is required to pay the premium or contribution at the agreed times, to answer accurately the questions asked by the insurer, in particular in the risk declaration form by which the insurer questions them when entering into the contract about the circumstances that enable the insurer to assess the risks it is taking on, and to declare, during the term of the contract, any new circumstances that have the effect of either aggravating the risks or creating new ones, thereby rendering the answers given to the insurer inaccurate or obsolete, in particular in the risk declaration form. The insurer is not liable for losses and damage arising from an intentional or fraudulent fault of the insured. The lender may make the loan offer conditional upon the borrower having their salary or similar income paid into a payment account, provided that the lender in return grants the borrower an individualised benefit. The services presented by the PLATFORM are intended for natural persons of legal age and for French residents.
Article 12 - Intellectual property
The structure of the site, as well as the texts, graphics, images, photographs, sounds, videos and computer applications that make it up, are the property of the PUBLISHER and are protected as such by the laws in force regarding intellectual property. Some photos or illustrations used by the PLATFORM come from royalty-free sources such as contributors to the Flaticon website.
Any representation, reproduction, adaptation or exploitation, in whole or in part, of the content, registered trademarks and services offered by the site, by any process whatsoever, without the prior, express and written authorisation of the PUBLISHER, is strictly prohibited and may constitute an infringement within the meaning of Articles L. 335-2 et seq. of the French Intellectual Property Code. This is with the exception of elements expressly designated as royalty-free on the site. Access to the site does not constitute recognition of a right and, in general, does not confer any intellectual property right relating to any element of the site, which remain the exclusive property of the PUBLISHER.
Users are prohibited from entering data on the site that would modify, or could modify, its content or appearance.
Article 13 - Applicable law and competent jurisdiction
These General Terms of Use are governed by French law. They are written in French. In the event of a dispute and failing an amicable agreement, the dispute shall be brought before the French courts in accordance with the applicable rules of jurisdiction.
